Will-Writing (part one)

Bismillah

From the title of this entry I'm sure that readers would have already guessed that this is going to be a pretty somber piece. However, I felt the need to write about this subject because it is one that we tend to sweep under the carpet, hence successfully neglecting it.

Firstly, let's see what the term 'will' has been defined as:

Main Entry: will
Function: noun
1 : the desire, inclination, or choice of a person or group
2 : the faculty of wishing, choosing, desiring, or intending
3 : a legal declaration of a person's wishes regarding the disposal of his or her property after death; especially : a formally executed written instrument by which a person makes disposition of his or her estate to take effect after death.

... definition (3) is the one I'll be focusing on here inshaa`Allaah.

I've decided, once again, to speak about death as it is a topic that has been quite close to home recently due to a few experiences I've had. So much so that I've been left to ask myself the following questions:

-- What will life for my husband and Junayd be like without me?
-- Who'll help my husband with Junayd to nurture and care for him?
-- In who's hands will my scarce savings be in when I'm not around?

I was even compelled to quickly jot down ways for my husband to let my valued readers know I'm no longer around.

Anyhow... the point is: have we thought about what will become of that which we own when we depart from this life? Have we thought about how our things will be distributed to those we leave behind?

Sadly, the answer in most cases is no. Take a look at what the Prophet Muhammad (sallallaahu 'alayhi wa sallam) had to say regarding this:

Narrated 'Abdullaah bin Umar

Allaah's Apostle said, "It is not permissible for any Muslim who has something to will to stay for two nights without having his last will and testament written and kept ready with him." (Saheeh al-Bukhaaree)

We should not let two-nights pass without writing a will if we have something to bequest; yet many of us, including myself, have let many years pass without doing so! Why? To put it simply: we don't think we're going to die anytime soon, so "why bother"?

Yes, I've been thinking a lot about this lately. Do you have a will sample? Because, I'm a little unsure on how to write one. (i.e. specification)

Yes ukhtee, I do have a specimen of what an Islaamic Will should kind of look like. It's a really long document and I suggest that you go through it with the leader of you local Islaamic community.

Since it's such a big file, I think I'll mail it to you. However, it will be available here when I complete part two of the entry inshaa`Allaah.
